What is the point of that distinction? One could argue that since the US doesn't care, it'd be hipocritical for them to protest any other country's acquisition.

Two points on N.Korea:

1) Didn't they disarm?
2) Wasn't there some question as to validity of the test? It was underground, but it was also ridiculously weak, and could have been a conventional bomb.

There really isn't a point in the distinction.

Well, technically from what I understand they only ever produced one device and they used it in a weapons test. So disarming wasn't much of a question.

They have the ability to produce weapons, which is what all the recent hullaboo was about because they had previously agreed to dismantle the weapons production aspect of their nuclear program and place their entire nuclear program under the watchful eye of the IAEA.
